If the purchase order requires payment within 30 days, the buyer should pay within 30 days.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">What interest can be claimed?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Section 16 makes the buyer liable for compound interest with monthly rests at&nbsp;<strong>three times the RBI bank rate<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, if the applicable RBI bank rate is 5.50%, the statutory nominal annual rate becomes:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>5.50% \u00d7 3 = 16.50% per annum, compounded monthly.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On an unpaid principal of \u20b910,00,000, a six-month delay at that rate would generate approximately&nbsp;<strong>\u20b985,400 in interest<\/strong>, subject to the exact due date, changes in the bank rate and any part-payments.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">How quickly should the Council decide?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Section 18(5) states that every reference should be decided within&nbsp;<strong>90 days<\/strong>&nbsp;from the date of making the reference.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is a statutory target. It should not be treated as a guarantee that money will reach the supplier within exactly 90 days because scrutiny, service, adjournments and Council workload can affect the actual timeline.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Is the system producing results?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The volume of claims is substantial. According to the Government\u2019s June 2026 data, the Samadhaan portal had received&nbsp;<strong>2,56,892 applications involving approximately \u20b955,244.29 crore<\/strong>. Results still depend upon:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>proper scrutiny of the claim;<\/li>\n\n\n\n<li>accurate buyer details;<\/li>\n\n\n\n<li>sufficient proof of delivery or service completion;<\/li>\n\n\n\n<li>the supplier\u2019s eligibility;<\/li>\n\n\n\n<li>timely notice to the buyer;<\/li>\n\n\n\n<li>Council capacity; and<\/li>\n\n\n\n<li>enforcement if an award is not voluntarily paid.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">What should an MSME do in 2026?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">For a new claim, use the ODR portal and keep the following ready:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Udyam registration and classification history;<\/li>\n\n\n\n<li>purchase orders or agreements;<\/li>\n\n\n\n<li>invoices;<\/li>\n\n\n\n<li>delivery challans, e-way bills or service-completion evidence;<\/li>\n\n\n\n<li>ledger and payment details;<\/li>\n\n\n\n<li>emails or messages acknowledging the dues;<\/li>\n\n\n\n<li>buyer\u2019s objections and proof of their resolution;<\/li>\n\n\n\n<li>demand notice; and<\/li>\n\n\n\n<li>invoice-wise principal and interest calculation.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Most importantly, file early. The Limitation Act, 1963 applies to Section 18 proceedings.
